FINRA plays a crucial role in processing fingerprint transactions, which firms initiate on behalf of their associated persons. These associated persons, working within FINRA-regulated firms, are bound by the fingerprinting requirements outlined in Rule 17(f)(2) of the Securities and Exchange Act of 1934.

According to this rule, fingerprint submissions must adhere to one of two methods

  1. Traditional Submission: Firms have the option to submit hard copy fingerprint cards directly to FINRA.

  2. Electronic Submission: Alternatively, firms can opt for a more efficient and streamlined approach by submitting fingerprint information electronically through FINRA’s Electronic Fingerprint Submission (EFS) Program.

It’s important to note that this fingerprinting process must be initiated within a 30-day timeframe after the submission of a U4 form to FINRA. Failure to do so necessitates the suspension of business activities for the employee or officer until the process is complete, ensuring full regulatory compliance.
